Oh yeah, Vic always has a plan. Nothing he said can be used against Ronnie, but Ronnie has no future outside of the barn, or a future there because of
Claudette and Dutch catching him delivering the money a few episodes ago. Poor Ronnie, but family first for Vic.

Question: is Vic's confession still considered evidence enough to take Ronnie down? Or does he need to be alive to testify in court about the things they have him on tape saying? Answer: Vic would be an unavailable witness under FRE 804(a)(4). However I don't think what he said would qualify as a hearsay exception under 804(b)(1) since it wasn't a deposition, and 804(b)(3) wouldn't work since this is not really a statement against interest given it was to get immunity. However, it might not be considered hearsay under 801(d)(2)(E) as the statement of a co-conspirator, but even then it wouldn't be proof of a conspiracy. |
